TERMS OF SERVICE – USA MECHANICAL BULLS

1. OVERVIEW

The www.usamechanicalbulls.com website (the “Site”) is operated by USA Mechanical Bulls, LLC. (“USA Mechanical Bulls”). Use of the Site is conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. Your use of the Site constitutes your agreement to all such Terms. USA Mechanical Bulls is an E-Commerce Site and Manufacturer of mechanical and inflatable amusement products.

2. CANCELLATION/REFUND POLICY

The Company maintains a strict refund policy to protect manufacturing and logistics overhead:

• Deposits: All deposits are strictly non-refundable. The company will cancel any order if the customer has not paid the stated deposit on their order form.

• Spare Parts: Sales of all spare parts are final; no refunds will be issued.

• Restocking Fee: Only authorized returns are permitted and are subject to a 50% restocking fee.

3. LIMITED PRODUCT WARRANTY

USA Mechanical Bulls provides the following limited warranty for its manufactured products:

• Warranty Period: Products are warranted to be free of all defects in material and workmanship for a period of 5 years and 1 month from the date of purchase.

• Eligibility: This warranty extends ONLY to the original buyer and is non-transferable.

• Company Obligations: Within the warranty period, USA Mechanical Bulls will repair, free of charge, any part proving defective in material or workmanship.

• Sole Authorized Facility: All warranty repairs and service must be performed exclusively by an authorized USA Mechanical Bulls technician at our sole authorized service facility located at 10880 Thienes Ave, South El Monte, CA 91733.

• Buyer Responsibilities: While the company assumes the cost of parts and labor for covered repairs, the Buyer is responsible for all shipping and freight costs.

• Warranty Exclusions: This warranty does not apply to:

1. Service calls to correct installation or explain product usage.

2. Repairs necessitated by use other than normal use. The Company reserves the sole right to determine "normal use" based on inspection.

3. Damage resulting from misuse, abuse, accidents, alterations, or improper installation.

4. Corrective work necessitated by repairs made by anyone other than an authorized USA Mechanical Bulls technician.

4. OBTAINING WARRANTY SERVICE

Upon discovery of any defect or malfunction, the Buyer must contact support@usamechanicalbulls.com immediately.

• Delivery: The buyer should carefully pack the product, preferably in the original packing materials, and deliver it, along with a copy of the original purchase receipt and a description of the problem, to the authorized facility in South El Monte, CA.

• Shipping Liability: If the product is sent by freight, the buyer is strongly encouraged to insure it. The Company accepts no liability for products lost or misplaced in shipment.

5. INDEMNIFICATION & LIABILITY

• Indemnity: You agree to indemnify, defend, and hold harmless USA Mechanical Bulls from any losses, costs, or liabilities (including attorney’s fees) arising from your use of the products, including personal injury claims.

• Risk of Loss: Risk of loss passes to the Buyer the moment the product is delivered to the carrier at our facility (FOB Shipping Point).

• Limitation of Damages: To the maximum extent permitted by law, the Company is not liable for incidental or consequential damages. Some states do not allow this exclusion, so it may not apply to every buyer.

6. DISPUTE RESOLUTION & GOVERNING LAW

• Binding Arbitration: Any dispute shall be settled by binding arbitration on an individual basis in California. Class actions are not permitted.

• Jurisdiction: This agreement is governed by the laws of the State of California. You consent to the exclusive jurisdiction of the courts in California for the enforcement of arbitration awards.

7. SEVERABILITY & ENTIRE AGREEMENT

• Severability: If any part of this agreement is determined to be invalid or unenforceable, that specific provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent, and the remainder of the agreement shall continue in effect.

• Entire Agreement: This constitutes the entire agreement between the user and USA Mechanical Bulls and supersedes all prior communications, whether electronic, oral, or written.
